AFFORDABLE HOUSING WITH LONG-TERM LIABILITY RIGHTS

The Housing Fund offers for sale a 2-bedroom, 1-bathroom apartment (93.40 m2), an indoor parking space, an 18.51 m2 garden, and a 10.18 m2 terrace.

ELIGIBILITY REQUIREMENTS:
- Be an individual
- Be a household with a maximum of 2 dependent children
- Possess a certificate of eligibility for the purchase of affordable housing issued by the Housing Assistance Service (11, rue de Hollerich L-1741 Luxembourg)
- Have a loan agreement issued by a financial institution
- Not own property in Luxembourg/abroad or commit to selling your property within the allotted timeframe

LONG-TERM LIABILITY RIGHTS:
The A share of the land on which the residence is built will be transferred to the purchasers via a long-term lease, for a period of 99 years. The annual fee payable will be €50 NI100 of the sliding-scale wage prices, currently €261.37/year. Upon expiration of the long-term lease, the Housing Fund reserves the option to: a) either offer an extension of the long-term lease for a period and under conditions to be determined between the parties; b) or reclaim the buildings erected on the land against payment of the value of the completed shell. OBLIGATION TO OCCUPY: The purchaser undertakes to occupy the dwelling as their primary and permanent residence for the entire duration of the long-term lease. The dwelling may not be sold, rented, or used for any purpose other than residential use for the entire duration of the long-term lease. RIGHT OF PRE-EMPTION: The Housing Fund has a right of Pre-emption rights for the entire duration of the long-term lease. The price the Fund must pay in the event of pre-emption is equal to the price paid by the purchaser to the Fund, increased according to the construction cost index (STATEC), and also depends on any potential losses incurred during the occupancy of the premises. TWO-YEAR AND TEN-YEAR GUARANTEES: The property falls within the scope of Articles 1792 and 2270 of the Civil Code, having been built less than 10 years ago.
