Article 3 - Description of services

Article 4 - Individual advertiser commitments

The individual advertiser agrees that the information provided regarding his real estate listings is correct and will be updated if the information changes during the ad's broadcast period. He will have to fill in all the information at his disposal and correctly fill in the characteristics of the property in order to provide internet users with qualitative research. Photos, videos or virtual tours inserted into a real estate advertisement must be an advertisement for real estate. The location of the property must be as precise as possible; it is forbidden to encode a locality other than the one where the property is located, especially if they are border locations, as this process misleads the users of our site.

The client must comply with the legal obligations that are specific to real estate listings in Luxembourg such as the obligation to display the class and the energy performance of published dwellings. Real Estate Media SA may forcibly remove a real estate advertisement if a competent authority so requires. In the aforementioned cases no refund of the value of the advertisement will take place.

We advise private advertisers to write the words "No agencies please" to warn real estate agencies of non-consent to be approached. Real Estate Media SA can not assume the responsibility for the non-inclusion of this mention by real estate agencies, we encourage individual advertisers to assert their rights with regards to the agencies concerned.

Article 5 - Liability

Real Estate Media SA does not intervene in transactions between advertisers and buyers. These transactions are subject to the laws in force in the country concerned. Our company declines any responsibility as for the accuracy of real estate advertisements, these being the responsibility of the advertiser.

The customer shall be aware of the possible disclosure of all or part of the content he posts on in the following cases:

- To comply with legal requirements or as part of legal proceedings,
- To protect the rights and interests of Real Estate Media SA in case of violation of these Terms and Conditions of Use and Sale,
- To ensure the dissemination of real estate information on all media of Real Estate Media SA (,, our pages on social networks, IMMOTOP.LU The Magazine) and on the media of our partners ( for ads in Lorraine, Mitula, Nestoria, Trovit,, Google Adwords, Criteo, Facebook Ads, Trackuity, and Bing).

Real Estate Media SA is subject to the obligation of means and will make every effort to ensure the proper functioning of its services. However, if an event beyond the control of Real Estate Media SA occurs (power grid failure, internet failure, external server failure, natural disaster, etc.) Real Estate Media SA cannot be held responsible or be solicited for any compensation.

Article 7 - Rates, payments, and invoices

The current rates correspond to those shown when creating an advertisement. Rates are subject to change at any time. Promotional offers can also be set up in ad hoc ways; they are exceptional and a similar rate cannot be required outside of the dedicated periods.

Means of payment:
Payments are only online via the user area. There are 2 means of online payment: payment by credit card and payment by bank transfer (an activation time corresponding to the time of receipt of payment is to be expected in this case).

The amount paid for the period subscribed is due. No refund shall be made in the event that the advertiser finds an purchaser before the end date of the advertisement.

The advertisement provision service furnished by IMMOTOP.LU is executed immediately. The individual advertiser will not be able to withdrawal once the amount has been paid since he has already enjoyed the service of broadcasting his advertisement.

Article 8 - Property

IMMOTOP.LU regularly publishes articles and visuals related to the real estate market. These publications may be disseminated by a third party such as an internet user provided that the source is mentioned with a hypertext link directed to and provided that the image of IMMOTOP.LU or Real Estate Media SA is not infringed upon.

No other content from Real Estate Media SA may be copied, reproduced, published, transmitted or distributed in any way. The modification of the contents or their use without the prior consent of Real Estate Media SA constitutes an infringement of the property rights of our company.

Article 9 - Jurisdiction

The use of the services provided by Real Estate Media SA is subject to the laws and regulations of Luxembourg. In the event of a dispute arising out of or relating to these General Terms and Conditions of Use and Sale, the Luxembourg courts shall be designated as the competent courts.

In the event that one of the clauses of these General Terms and Conditions of Use and Sale is deemed illegal, void, or not applicable for any reason whatsoever, this will not affect the validity or the application of other clauses deemed admissible.
